What Is a Removal Center?

A Removal Center is a facility defined under Law No. 6458 on Foreigners and International Protection, where foreign nationals subject to deportation orders are held under administrative detention. These centers serve as temporary shelters for migrants, providing for their basic humanitarian needs during their stay.

Establishment and Responsibilities of Removal Centers

Removal centers are established in provinces or districts with high numbers of irregular migrants. The location is determined by the Directorate General of Migration Management and submitted to the Ministry of Interior for approval. Once approved, the center is officially established in the designated area.

With the recommendation of the Provincial Governor’s Office and the approval of the Directorate General, these centers begin operating to accept and house migrants. In emergency situations, temporary removal centers may also be set up.

These centers aim to house apprehended irregular migrants until their repatriation procedures are completed, and to prevent the dispersion of migrants throughout Turkey during this process.

Can Detainees in Removal Centers Meet with a Lawyer?

Yes. Foreign nationals held in removal centers have the right to meet with a lawyer. These centers are equipped with designated rooms specifically for attorney-client meetings.

Who Is Held in Removal Centers?

Removal centers house foreign nationals who are subject to deportation orders and have been placed under administrative detention. According to Law No. 6458, a foreigner may be held in a removal center under the following circumstances:

  • Individuals considered at risk of absconding or disappearing

  • Those who violate Turkey’s entry or exit rules

  • Persons using false or fraudulent documents

  • Those who fail to leave Turkey within the prescribed time without a valid reason

  • Individuals who pose a threat to public order, public security, or public health

How Long Can a Foreign National Be Held in a Removal Center?

According to Law No. 6458 on Foreigners and International Protection, the maximum duration of administrative detention is six months. This period may be extended once for an additional six months if deemed necessary, but the total duration cannot exceed one year.

The Governor’s Office regularly reviews the status of each individual under administrative detention on a monthly basis. If it is determined that the conditions requiring detention no longer exist, the detention order must be terminated (Article 61/2 of Law No. 6458).

Just like a deportation order, the administrative detention order must be officially notified to the foreign national, as well as to their legal representative or attorney, if applicable. The content of the decision must be explained, and the individual must be given the opportunity to exercise their right to appeal.

Is It Possible to Be Released from a Removal Center?

Foreign nationals held in removal centers are subject to administrative detention for deportation purposes. While this measure is more restrictive than alternative precautions, it is not unlimited.

Who Transfers the Detainee to the Removal Center, and Within What Timeframe?

Foreign nationals who are subject to an administrative detention order must be transferred to a removal center (GGM) by the apprehending law enforcement units within 48 hours at the latest.

All basic needs and related expenses of foreign nationals held in removal centers are covered by the Provincial Directorate of Migration Management or the management of the removal center. These include:
